1. Acceptance of Terms

By accessing or using ONUNDI ("the Platform," "we," "us," or "our"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Platform.

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

2. Description of Service

ONUNDI is a platform that allows users to discover other content creators, post projects, send messages, and explore collaboration opportunities.

We provide a networking tool only. We do not guarantee any particular outcome, exposure, collaboration, or result.

We may modify, suspend, or discontinue the Platform at any time without liability.

3. User Accounts

3.1 Eligibility: You must be at least 18 years old to use ONUNDI.

3.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3.3 Accurate Information: You agree to provide accurate, current, and complete information.

3.4 Termination: We reserve the right to suspend or terminate accounts for violations, harmful behavior, or inactivity. We have no obligation to retain or store your data after termination.

4. User Responsibilities and Conduct

You agree NOT to:

  • Use the Platform for any illegal or unauthorized purpose
  • Post harmful, abusive, defamatory, or hateful content
  • Harass, stalk, or intimidate other users
  • Share false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Upload viruses, malware, or harmful code
  • Attempt to access restricted systems or data
  • Scrape, crawl, or use automated systems without permission
  • Infringe intellectual property rights

Users are solely responsible for all interactions, communications, files, and content they share on or through the Platform.

5. User Content

5.1 Ownership: You retain ownership of the content you create and upload. By using the Platform, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to display, distribute, and promote your content in connection with the Platform.

5.2 Responsibility: You are solely responsible for all content you post.

5.3 Removal of Content: We reserve the right to remove any content at our discretion without notice.

6. User Interactions and Third-Party Activity

6.1 No Involvement: ONUNDI is not a party to any interactions, contracts, collaborations, agreements, transactions, or disputes between users.

6.2 No Guarantees: We do not guarantee:

  • The identity of any user
  • The quality, legality, or reliability of any collaboration
  • The outcome of any project
  • The accuracy of information provided by users

6.3 No Professional Advice: ONUNDI does not provide legal, financial, creative, or business advice. All decisions made based on interactions on the Platform are your own responsibility.

7. Payments

7.1 Billing: Subscription payments are prepaid and processed by Stripe. ONUNDI does not store your payment details; these are processed by authorized third-party providers.

7.2 Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

7.3 Price Changes: We may change prices at any time with notice before your next billing date.

8. Intellectual Property

All Platform code, design, features, branding, and content (except user-generated content) are owned by ONUNDI and protected under applicable intellectual property laws.

You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.

9. Copyright Complaints (DMCA / EU Notice Requirements)

If you believe content on the Platform infringes your copyright, please contact us at [email protected] with a detailed notice.

We may remove infringing content and terminate accounts of repeat infringers.

10. Privacy and Data Processing

Our collection and use of personal data is governed by our Privacy Policy. By using the Platform, you consent to such processing and agree to comply with GDPR and applicable data protection laws.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content
  • Availability or uptime

We do not guarantee that the Platform will be uninterrupted, error-free, or secure.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONUNDI, ITS OWNERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, business, or goodwill
  • Any damages arising from user interactions or disputes

Our total liability shall not exceed €100 or the total amount you have paid us in the past 12 months, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless ONUNDI from any claims, damages, losses, or expenses arising from:

  • Your use of the Platform
  • Your content
  • Your interactions with other users
  • Your violation of these Terms
  • Your violation of rights of any third party

14. Monitoring and Enforcement

We do not monitor private messages but may review content if necessary for:

  • Safety or legal compliance
  • Enforcement of Terms
  • User reports or legal requests

We are not responsible for user communications or content.

15. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be resolved exclusively in the courts of Ireland, unless otherwise required by mandatory local laws.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, along with our Privacy Policy and other referenced policies, constitute the entire agreement between you and ONUNDI.

Refund Policy

This Refund Policy explains how subscription payments, cancellations, and refunds are handled for ONUNDI Pro and any other paid services.

We aim to keep the policy fair, transparent, and simple, while limiting our financial and legal exposure.

1. General Refund Principles

All payments on ONUNDI are processed by Stripe. By purchasing a subscription, you agree to Stripe's terms and our Terms of Service.

Refunds are handled in accordance with applicable consumer protection laws. Nothing in this policy limits your statutory rights under EU consumer law.

We do not guarantee refunds for:

  • User error
  • Lack of usage
  • Change of mind
  • Dissatisfaction with other users
  • Issues unrelated to our Platform

2. Subscription Payments

Subscriptions are prepaid and renew automatically. You authorize us to charge your payment method each billing cycle.

Renewal dates are clearly displayed in your account. You are solely responsible for managing your subscription.

We are not responsible for failed payments due to expired cards or insufficient funds.

3. Refund Eligibility

Refunds may be granted ONLY in the following limited situations:

✔️ 3.1 Duplicate Payment

If you were charged twice for the same billing period.

✔️ 3.2 Technical Issues Preventing Service

If the Platform was completely unavailable due to our fault for 72+ consecutive hours and you notified us during that time.

✔️ 3.3 EU Consumer Cooling-Off Period

Under EU law, users may request a refund within 14 days of purchase ONLY if they have not used the paid features.

Once paid features are accessed or used, the right to withdrawal expires immediately.

4. Non-Refundable Situations

Refunds will NOT be issued for:

  • ❌ Change of mind
  • ❌ Lower than expected results or performance
  • ❌ Issues caused by user error or negligence
  • ❌ Disputes between users
  • ❌ Failure to cancel on time
  • ❌ Temporary downtime or maintenance
  • ❌ Violations of our Terms of Service
  • ❌ Using ONUNDI for unlawful or prohibited activities
  • ❌ Account termination due to your own actions
  • ❌ Features working as designed but not meeting your expectations
  • ❌ Third-party service issues (Stripe, Firebase, etc.)

5. How to Request a Refund

  • Your account email
  • Date of payment
  • Payment receipt (Stripe automatically emails one)
  • Explanation of the issue

We aim to respond within 7 business days. We may request additional information to verify your claim.

All discretionary refund decisions are final.

6. Cancellations

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

You will continue to have access until the period expires. No partial refunds for early cancellation.

We do not prorate unused time.

7. Chargebacks

Initiating a chargeback without contacting us first:

  • Permanently terminates your account
  • Forfeits all access to ONUNDI
  • May result in a permanent ban from future use
  • May be contested with evidence of service delivery
  • May result in collection action for disputed amounts

If you have an issue, contact us first — we respond quickly and fairly.

8. Limitation of Liability

Our maximum liability for any refund-related claim shall not exceed the amount paid during the relevant billing period.

We are not liable for indirect or consequential damages, or for errors by Stripe or your bank.

9. Changes to this Policy

We reserve the right to update this Refund Policy at any time. Your continued use of the Platform and payment for services constitutes acceptance of any changes.
