1. Acceptance of Terms
By accessing or using ONUNDI ("the Platform," "we," "us," or "our"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Platform.
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
2. Description of Service
ONUNDI is a platform that allows users to discover other content creators, post projects, send messages, and explore collaboration opportunities.
We provide a networking tool only. We do not guarantee any particular outcome, exposure, collaboration, or result.
We may modify, suspend, or discontinue the Platform at any time without liability.
3. User Accounts
3.1 Eligibility: You must be at least 18 years old to use ONUNDI.
3.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.3 Accurate Information: You agree to provide accurate, current, and complete information.
3.4 Termination: We reserve the right to suspend or terminate accounts for violations, harmful behavior, or inactivity. We have no obligation to retain or store your data after termination.
4. User Responsibilities and Conduct
You agree NOT to:
- Use the Platform for any illegal or unauthorized purpose
- Post harmful, abusive, defamatory, or hateful content
- Harass, stalk, or intimidate other users
- Share false, misleading, or fraudulent information
- Impersonate any person or entity
- Upload viruses, malware, or harmful code
- Attempt to access restricted systems or data
- Scrape, crawl, or use automated systems without permission
- Infringe intellectual property rights
Users are solely responsible for all interactions, communications, files, and content they share.
5. User Content
5.1 Ownership: You retain ownership of the content you create. By using the Platform, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to display and distribute your content.
5.2 Responsibility: You are solely responsible for all content you post.
5.3 Removal: We reserve the right to remove any content at our discretion without notice.
6. User Interactions
ONUNDI is not a party to any interactions, contracts, collaborations, agreements, transactions, or disputes between users.
We do not guarantee: user identity, collaboration quality, project outcomes, or accuracy of user-provided information.
ONUNDI does not provide legal, financial, creative, or business advice.
7. Payments
Subscription payments are prepaid and processed by Stripe. We do not store payment details. You may cancel anytime; cancellation takes effect at period end. Prices may change with notice.
8. Intellectual Property
All Platform code, design, features, and branding are owned by ONUNDI. You may not copy, modify, or reverse-engineer any part without consent.
9. Copyright Complaints
Report infringement to support@onundi.com. We may remove infringing content and terminate repeat infringers.
10. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE ACCURACY, RELIABILITY, AVAILABILITY, OR SECURITY.
11. Limitation of Liability
ONUNDI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY: โฌ100 OR 12 MONTHS PAID, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify ONUNDI from claims arising from your use, content, interactions, or violations.
13. Governing Law
These Terms are governed by the laws of Ireland. Disputes resolved in Irish courts.
14. Content Moderation (Digital Services Act)
Reporting: Users can report illegal content or violations via the in-app Report function or by emailing support@onundi.com.
Response Time: We aim to review all reports within 48-72 hours and take appropriate action.
Notification: If your content is removed or your account is restricted, you will be notified with the reasons for the decision.
Appeals: You may appeal content moderation decisions by contacting support@onundi.com within 14 days. Appeals are reviewed by a different team member where possible.
Transparency: We may publish periodic reports on content moderation activities as required by applicable law.
๐ณ Refund Policy
1. General Principles
All payments processed by Stripe. Refunds are at our sole discretion except where required by law.
No refunds for: user error, lack of usage, change of mind, dissatisfaction with users, or unmet expectations.
2. Subscription Payments
Subscriptions are prepaid and auto-renew. You're responsible for managing your subscription. We're not responsible for failed payments from expired cards.
3. Refund Eligibility (Limited)
Refunds may be granted ONLY for:
- โ๏ธ Duplicate charges (our error)
- โ๏ธ 72+ hour outage (our fault, during your billing period)
- โ๏ธ EU 14-day cooling off (only if NO paid features used)
Once paid features are used, EU withdrawal right expires.
4. Non-Refundable Situations
- โ Change of mind
- โ Lower than expected results
- โ User error or negligence
- โ Disputes between users
- โ Failure to cancel on time
- โ Temporary downtime/maintenance
- โ Account suspension for violations
- โ Features working as designed
- โ Third-party service issues
5. Requesting a Refund
Email support@onundi.com with: account email, payment date, receipt, and explanation. All decisions are final.
6. Cancellations
Cancel anytime via account settings. Takes effect at period end. No proration.
7. Chargebacks
Chargebacks without contacting us first = permanent ban, account termination, and potential collection action. Contact us first.
8. Governing Law
This policy is governed by the laws of Ireland.
