Terms of Service & Refund Policy

By accessing or using ONUNDI ("the Platform," "we," "us," or "our"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Platform. We may update these Terms from time to time; where a change materially affects your rights or obligations we will provide reasonable notice as described in Section 26.
1. What ONUNDI Is
ONUNDI is a platform intended to help creators, professionals and other users discover and arrange legitimate creative, professional and collaborative projects: creating profiles, describing skills and interests, publishing collaboration opportunities, searching for collaborators, communicating with other users, sharing links and relevant information, and organising or discussing projects.
Unless expressly stated otherwise, ONUNDI is not a party to agreements made between users and does not employ, represent or act as agent for users. Users are responsible for deciding whether to collaborate with another person and for agreeing the terms of any collaboration.
ONUNDI is not: a dating service, a hook-up service, an escort marketplace, a pornography platform, an adult-industry recruitment platform, or a sexual-services marketplace.
2. Eligibility
2.1 Minimum age. You must be 16 years of age or older to create an account or use member features of ONUNDI. By registering, you represent and warrant that you are at least 16 years old. A person under 16 must not create an account, create or maintain a profile, publish a collaboration, contact users through ONUNDI, or use another person's account. ONUNDI may request reasonable and proportionate evidence of age where necessary for safety, fraud prevention, legal compliance or enforcement, and may restrict or terminate an account where we reasonably believe the user is under 16 or has misrepresented their age.
2.2 Paid subscriptions require you to be 18 or older. Regardless of the general 16+ minimum, you must be 18 years of age or older to purchase or hold a paid subscription tier on ONUNDI. This reflects the limited contractual capacity of minors under Irish law and the payment-processing terms we rely on. Users aged 16 or 17 may use ONUNDI's free features but may not subscribe to a paid tier; if we become aware that a paid subscription is held by someone under 18, we may cancel it and refund the affected billing period.
2.3 No circumvention. You must not assist a person under 16 in circumventing ONUNDI's age requirements, or knowingly create, maintain or provide an account for an under-16 user.
3. Account Responsibilities
You must provide information that is accurate to the best of your knowledge. You are responsible for maintaining the confidentiality of your login credentials, activity occurring through your account, keeping your contact information reasonably current, and notifying us if you believe your account has been compromised.
You must not: impersonate another person or organisation; misrepresent your identity in a materially deceptive way; create accounts to evade enforcement; buy, sell or transfer accounts without permission; or use automated means to create accounts or abuse the Platform.
4. Professional and Non-Sexual Use Only
ONUNDI exists for legitimate creative and professional collaboration. Sexual solicitation, pornography, adult entertainment recruitment and sexual services are not permitted on ONUNDI. These restrictions apply to profiles, biographies, photographs, videos, usernames, project listings, collaboration requests, messages, comments, links, external contact information and any other material or conduct facilitated through ONUNDI.
A user cannot avoid these rules simply by moving prohibited activity from ONUNDI to WhatsApp, Telegram, Discord, email, another website or an offline meeting.
5. Sexual and Adult Content
5.1 Pornography. You must not use ONUNDI to create, post, request, advertise, distribute, promote, solicit, arrange or facilitate pornography or content primarily intended for sexual gratification, including pornographic photography or video, explicit sexual performances, sexually explicit livestreaming, pornography production, sexually explicit webcam activity, or any content primarily intended for sexual gratification.
5.2 Adult-industry recruitment. You must not recruit, advertise for or seek participants for: pornography; adult films; sexually explicit photo or video shoots; explicit subscription-platform content; sexual livestreaming; adult webcam content; stripping or sexually explicit performances; escort services; prostitution; sexual services; erotic massage offered as a sexual service; fetish services of a sexual nature; commercial sexual activity; or substantially similar adult-industry activities.
This prohibition applies even where the recruitment advertisement itself contains no nudity or explicit imagery. Examples of prohibited wording include statements such as "looking for women interested in the adult industry" or "looking for people who love sex and want to be filmed," regardless of whether the profile photograph itself is explicit.
5.3 Sexual solicitation. ONUNDI must not be used to seek sexual partners, solicit sex, arrange sexual encounters, request sexual contact, advertise sexual availability, pressure another user into sexual activity, or disguise sexual solicitation as a collaboration.
5.4 Explicit imagery. Users must not upload or distribute explicit genital imagery, sexual acts, masturbation, explicit fetish material, pornographic nudity or non-consensual intimate imagery. ONUNDI may restrict other sexualised imagery where context reasonably indicates that its principal purpose is sexual solicitation or adult-content promotion.
6. Legitimate Creative Content
ONUNDI does not prohibit legitimate creative work merely because it concerns adult themes. Legitimate work may include fashion, journalism, documentary filmmaking, health education, relationship education, performing arts, fine art, film and television, and photography. However, ONUNDI may remove material where its context, presentation, purpose or intended collaboration indicates that it is primarily intended for pornography, sexual gratification, sexual services or adult-industry recruitment. ONUNDI may make reasonable moderation judgments based on context rather than individual words alone.
7. Child Safety
ONUNDI has zero tolerance for child sexual exploitation, grooming or sexualisation of anyone under 18 years old — this protection applies regardless of ONUNDI's own 16+ platform eligibility age, since child-protection law defines a "child" or "minor" as anyone under 18. 8. Harassment, Exploitation and Abuse
Users must not: harass, threaten, stalk or intimidate another user; blackmail or sexually harass users; repeatedly send unwanted sexual messages; coerce another person; exploit a person's vulnerability; pressure someone into creating sexual content; threaten to release intimate images; distribute non-consensual intimate content; deceive somebody about the true nature of a proposed collaboration; use professional opportunities as leverage for sexual activity; or facilitate human trafficking or exploitation.
9. Illegal and Dangerous Activity
You must not use ONUNDI to facilitate criminal activity, fraud, scams, trafficking, violence, credible threats, serious exploitation, the sale or distribution of illegal goods or services, malware or malicious activity, unlawful discrimination or infringement of another person's intellectual-property rights.
10. User Content
You retain ownership of content that you create and submit to ONUNDI, subject to the rights granted below. By posting content, you grant ONUNDI a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format and technically process that content only to the extent reasonably necessary to operate the Platform, display your content according to your settings, provide Platform functionality, moderate and secure the Platform, investigate abuse, and comply with legal obligations.
This licence ends when the content is deleted, except where technical backup copies temporarily remain, continued retention is required by law, retention is necessary for legitimate fraud, security, enforcement or legal purposes, or content has lawfully been shared by another user independently of your account. You must have the rights necessary to upload any content you submit.
11. Moderation
ONUNDI may review content and activity where reasonably necessary for user safety, enforcement of these Terms, responding to reports, preventing abuse, preventing fraud, legal compliance and protecting the security and integrity of the Platform. ONUNDI is not required to proactively monitor every piece of content or every user interaction unless applicable law requires otherwise. ONUNDI does not currently use automated content-scanning tools; moderation is performed by human review of reports.
12. Enforcement
If we reasonably believe that these Terms have been violated, ONUNDI may take one or more enforcement measures, including: warning the user; removing or hiding content; restricting visibility; disabling messaging; restricting features; temporarily suspending an account; permanently terminating an account; blocking creation of replacement accounts; preserving evidence; and referring matters to competent authorities where appropriate.
13. Immediate Suspension or Termination
ONUNDI may suspend, restrict or permanently terminate an account immediately and without prior warning where reasonably considered appropriate. A prior warning is not required before enforcement unless applicable law specifically requires one. Immediate permanent termination may be used for a first offence, including: pornography; adult-industry recruitment; sexual solicitation; child-safety violations; grooming; suspected exploitation; trafficking; serious harassment; credible threats; fraud; serious deception; illegal activity; attempting to evade a previous suspension; repeatedly violating the Terms; or conduct reasonably presenting a substantial safety risk.
14. Notice After Enforcement
Where applicable law requires ONUNDI to provide notice or a statement of reasons concerning an enforcement decision, we will provide such information as required by law — this does not mean advance warning before removing content or disabling an account, and where lawful, notification may occur after the restriction takes effect. If your content is removed or your account is restricted, we aim to notify you with the reasons for the decision. ONUNDI may withhold or limit information where disclosure would violate applicable law, interfere with a criminal investigation, reveal confidential security mechanisms, materially facilitate circumvention of Platform protections, create a serious risk to another person's safety, or improperly disclose another person's personal information.
15. Appeals and Complaints
Where ONUNDI provides an appeal mechanism, or where applicable law requires one, you may challenge an eligible moderation decision by contacting support@onundi.com within 14 days of the decision. Appeals are reviewed by a different team member where reasonably possible. Submitting an appeal does not automatically reactivate an account, restore removed content or suspend the enforcement decision — ONUNDI may maintain restrictions while an appeal is reviewed. We may publish periodic reports on content-moderation activity as required by applicable law.
16. Reporting Content
Users may report suspected violations using available in-app reporting tools or by emailing support@onundi.com. A report should, where reasonably possible, identify the account or content concerned, its location, the reason it is believed to violate these Terms or applicable law, and any relevant supporting information. We aim to review reports within 48–72 hours and take appropriate action. Reports involving suspected child exploitation, grooming, trafficking, credible threats, immediate physical danger or non-consensual intimate imagery are prioritised for urgent review.
17. Off-Platform Activity
ONUNDI does not generally control conduct occurring wholly outside the Platform. However, we may take enforcement action where ONUNDI has been used to initiate, arrange or facilitate conduct prohibited by these Terms. For example, a user cannot recruit for pornography through an ONUNDI profile and avoid enforcement merely by asking applicants to continue the discussion on another service.
18. Safety of Collaborations
ONUNDI does not guarantee another user's identity, qualifications, intentions, reliability, that a project is safe, that a collaboration will proceed, or that information supplied by another user is accurate. Users should exercise reasonable care before meeting another person, travelling for a collaboration, providing financial information, making payments, sharing identity documents or sharing personal contact details. Nothing in this section limits liability that cannot legally be excluded.
19. Intellectual Property
The ONUNDI name, branding, software, interface, website design and proprietary materials are owned by or licensed to ONUNDI. Except where permitted by law, users may not reproduce our software, reverse engineer Platform software, copy protected Platform assets, falsely represent affiliation with ONUNDI, or misuse our trademarks.
20. Copyright Complaints
If you believe content on ONUNDI infringes your copyright or other intellectual-property rights, contact support@onundi.com with enough information for us reasonably to identify the protected work, the allegedly infringing material, its location, your contact information and the basis for your claim. We may remove infringing content and terminate repeat infringers.
21. Platform Availability
We aim to keep ONUNDI available but cannot guarantee uninterrupted or error-free service. We may update the Platform, change features, temporarily suspend services, perform maintenance or discontinue features, and will provide notice where required by applicable law.
22. Fees and Paid Services
Where ONUNDI offers paid services, the applicable price, billing period, renewal terms, material service features and cancellation conditions will be presented before purchase. As set out in Section 2.2, you must be 18 or older to purchase a paid subscription. Subscription payments are prepaid, auto-renewing, and processed by Stripe; we do not store your full payment details. Nothing in these Terms limits mandatory consumer rights available under Irish or EU law.
23. Refunds
23.1 General principles. All payments are processed by Stripe. Refunds are at our sole discretion except where required by law or stated below. No refunds are given for user error, lack of usage, change of mind, dissatisfaction with other users, or unmet expectations.
23.2 Subscription payments. Subscriptions are prepaid and auto-renew. You are responsible for managing your subscription and payment method; we are not responsible for failed renewals caused by expired or declined cards.
23.3 Refund eligibility (limited). Refunds may be granted only for: duplicate charges caused by our error; a 72-or-more-hour outage caused by our fault occurring during your billing period; or the EU 14-day cooling-off right, which applies only if no paid features have been used during that period. Once paid features are used, the EU withdrawal right expires as permitted under EU consumer law.
23.4 Non-refundable situations include: change of mind; lower-than-expected results; user error or negligence; disputes between users; failure to cancel on time; temporary downtime or maintenance; account suspension for violations; features working as designed; and third-party service issues.
23.5 Requesting a refund. Email support@onundi.com with your account email, payment date, receipt, and an explanation. Decisions communicated to you are final.
23.6 Cancellations. Cancel anytime via account settings; cancellation takes effect at the end of the current billing period with no proration.
23.7 Chargebacks. Filing a chargeback without contacting us first may result in permanent account termination and potential collection action. Please contact us first so we can resolve the issue directly.
Nothing in this refund policy excludes rights that cannot lawfully be excluded, and users may always contact support@onundi.com regarding billing disputes.
24. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful. To the maximum extent permitted by law, ONUNDI is not responsible for losses arising solely from another user's independent misconduct, arrangements made between users, information supplied by another user, or a user's failure to exercise reasonable care. Subject to the foregoing, our total liability for any claim relating to paid services is limited to the greater of €100 or the total amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits statutory consumer rights.
25. Indemnity
To the extent permitted by applicable law, users acting in the course of a business agree to indemnify ONUNDI against losses reasonably arising from their unlawful use of the Platform or material breach of these Terms. This provision does not apply where prohibited by mandatory consumer law.
26. Changes to These Terms
We may update these Terms for reasons including changes to the Platform, security improvements, legal requirements, regulatory guidance, new services and safety measures. Where changes materially affect users' rights or obligations, we will provide reasonable notice where required by law. The current version displays its effective date at the top of this page.
27. Governing Law
These Terms are governed by the laws of Ireland, without depriving consumers residing in another EU or EEA country of mandatory protections available under the law applicable to them. The Irish courts have jurisdiction, subject to mandatory consumer-jurisdiction rules under applicable EU law.
